TERMS OF SERVICE

These terms of service may change at any time.

​

​

1. GENERAL INFORMATION

​​

  • Prices will vary based on the complexity of the model.

​

  • By commissioning me, you are agreeing to these terms of service and confirming that you are over 18 years of age.

​

  • I reserve the right to post any image related to the project on my social media and my portfolio, like WIP images or final renders. I will ask beforehand if you wish to be tagged on it.

  • Commissions are for personal use only. If you wish to use the artwork for commercial use, please contact me via email with your terms and purposes so we can discuss them.

​

  • Commission requests will be accepted via Google Forms, which will be announced on my social media (Twitter mainly).

​

I reserve the right to turn the commission down on any grounds, these include:

​​

  • NSFW or sexual content.

  • Offensive, disrespectful or hateful content.

  • Poor or lack of reference material.

  • Not owning the rights of the character.

  • Use in NFT or Blockchain-related content.

  • Use the artwork to create AI-generated images.

  • Being very complex or outside of my capabilities to do.

2. PAYMENT

​

  • The accepted currency is Euro.

​

  • Payment will be via PayPal invoice. Paypal fees are paid by the client.

​

  • Payments via bank transfer are available for Spain residents.

​

  • Commissions under 150 € will be paid upfront.

​

  • Commissions between 150 € and 300 € can be paid either 100% upfront or 50% upfront and 50% after the blocking is approved.

​

  • Commissions over 300 € can also be paid 40% upfront, 30% after the blocking is approved and 30% before sending the final model files.

​

  • I'll invoice for the whole price if no preference is given.

​

  • If for whatever reason you can't make a payment, I'll stop production with no problems until you can make the payment.

  • Please do not send me any payment before I have given you a slot and sent you the invoice.

​

  • If you would like for your commission to be private, an extra fee of 50% of the final price will be added. 

​

  • As a Spanish freelancer, I am required to include the full name and address of my clients, which Paypal will provide me, on sales invoices. Your information will be kept private and will not be shared with anyone else or used for any other purpose. Lying about your personal information will result in cancellation and possible blacklisting, as it could put me and my business in danger.

3. PROCESS

​

  • I will begin work within a week after the first invoice is paid.

​​

  • Commissions may take from a couple of weeks up to 2 or more months, depending on the complexity. If anything comes up that will slow/stop the progress of the initially estimated delivery time I will let you know as soon as possible.

​

  • I do not work on weekends and holidays (Spain).

​

  • I work on one commission at a time following the queue order.

​

  • I will send you progress updates of the model to keep you updated and make sure you are happy with how it's turning out.

​

  • Before taking major steps in the process I will request approval to avoid making mistakes and wasting time.

​

  • For posable models, I will tweak and fix the model as many times as necessary until it is fully bug-free, without very odd deformations while posing.

  • After production starts I may suggest changes to elements that may not translate well into 3D. This would be free and optional.

​

  • Once the piece is finished you will receive the final 3D model, renders, and files via Google Drive. Once you have downloaded the files I will take them down.

​

  • If the final files have been sent to the client and no reply has been received after 3 business days, I'll consider the commission completed.

​

​

4. REVISIONS
 

  • You get 3 rounds of changes on the commission included in the price. A fee will be added if you want additional changes unless they are due to a misunderstanding on my part. The amount of the extra charge will depend on the complexity and required time. You must agree to the price before I make any changes.

​

  • Should such fees come up, I will send you an additional invoice upon completion of the model, which must be paid before you receive the finished model.

​

  • I'll only accept a few big changes during the block out stage.

​

  • I will do what I can to satisfy my customers during the entire process of the commission, so If you have a problem with anything in regards to the commissioned piece please tell me right away so we can work a solution together.
     

  • There are no free revisions included in the custom Portrait/Bust Sculpts. Any extra changes will be discussed and agreed for an extra cost if I accept to make them.

7. REFUND AND CANCELLATION

 

  • If for any reason I am unable to start your commission you will receive a full refund. You are not entitled to any compensation beyond that.

​

  • If you cancel your order before I started it, you can get a full refund.

​

  • The buyer is not entitled to a full refund once I started working on the commission. However, I may give a partial refund based on how much of the work I have done.

​

  • The standard invoice PayPal fee (2,9%) will be deducted from the total refund.

​

  • Refunds are not available for finished artwork.

​

  • If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to your account myself.​

​

  • If you request a PayPal chargeback at any point when you were not allowed to ask for a refund you will lose all mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talked about the commission as evidence that I have completed work for you. I reserve the right to blacklist for commissioning me again.

  • If the buyer breaks any of the points stated above they will lose all the mentioned rights to the artwork commissioned, and I will have the right to profit further from the commissioned artwork in any way.

5. COPYRIGHT


I claim the rights to the produced model, not the buyer. Therefore I am allowed to use the copyrighted artwork to:

​

  • Promote myself with it everywhere.

  • Display it everywhere to my liking (Portfolio, social media, etc.)

  • Post it wherever I want.


You, the buyer are allowed to:

 

  • Use the commissioned piece for personal use only unless agreed otherwise (you can upload it on all your social media profiles, forums, etc)

  • Make more renders / 3d print the model and claim the character as your own, but not the model itself.

  • Use the artwork to promote yourself. You are not required to give me credit when you post it but it is very appreciated.

  • Use the Model on your Video/Streaming channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.

  • Use the model as a custom avatar for games.

  • Alter the model (add/change the rig, clothes, etc)


The following is considered copyright infringement:

​

  • Reproducing/using the copyrighted artwork commercially - selling the model or products made using the model.

  • Using the commissioned artwork in blockchain-based technology (such as minting the artwork as a Non Fungible Token (NFT)).

  • Using the commissioned artwork to create AI-generated images.

  • Claiming the model as your own.

 
I reserve the full rights to the model and its use/distribution unless otherwise agreed upon (rights to the model for your own non-personal use may be purchased at any time).
